M.H. vs DCF, July 10, 2009, 3rd District Court of Appeal

A child, M.H. was taken out of the mother’s home by DCF. During the time the child was out of the home, DCF placed the child with the maternal grandmother.

The mother apparently complied with all conditions of the court. At some point the court entered an order of reunification – placing the child back with the mother.

At the same time the court entered an order allowing regular, scheduled visitation with the paternal grandmother.

The appeals court reversed the visitation order, ruling that once a child is returned to his or her parent, grandparent visitation rights shall terminate.
