    Default When I fire my divorce attorney....

    I intend to "release" my divorce lawyer at our next appointment and retain another - you.

    Do I have the right to walk out of his office with the entire case folder - including all correspondence relating to the case - and an itemized billing record?

    Unfortunately some lawyers play games with the file documents. Some don't.

    The rule is:


    1. Any documents you give them are your property.
    2. Any documents they generate or receive are their property - but you have the right to request and get copies.
    3. They must provide a billing statement within a reasonable time of your request.
    4. If your bill is unpaid, they have the right to retain the documents in number 2.
