    Default relocation of non costodial parent

    My divorce was final in November, 08 but we did not fall under the new law and do not have a parentingicon plan. Our divorce spells out visitation. While my ex lived in Florida I accomodated every visitiation (brought her to him and picked her up most times because he would not). After school let out he stated he ws going out of town to "work." He was gone most of the summer. He came back for one week in July and I accomodated his request to see his child in the middle of the week. We fought for two days of the week and he finally gave her back. He has now confessed that he was relocating to Michigan to be with his girlfriend. He has had minimal contact with his child since then. He even told her to meet him at his parents house when he was in Florida last month. I drove over 3 hours and was there at the specified time and he had left early in the morning (no notice)

    So the question he called for the first time in a month and wants to take the child to Michigan to see snow. Do I have to send this child (special needs) across the country? I have received no support since the day he walked out, he has never followed the visitation agreement. And of course my biggest fear is she won't be returned. The last time he had her we were on the phone and he was convincing her to tell me she did not want to come home. As I stated it took two days and a police escort to get her back last time and that was in the same town. What are my rights?

    Normally you should cooperate with the other parent - no matter what.

    I would say you have adequate reasons to be worried. You should have definite provisions and safeguards in place.

    Your best bet is to file a modificationicon petition. A riskier method would be to withhold visitation and make him file for enforcement.
