Default Spouse is in jail for contempt for non support, can I still get a divorce

my soon to be ex-spouse is in jail for contempt for non-support. all of my paperwork for the divorce proceedings have been filed but I do not have a court date. can I get a hearing and divorce while he is in jail or do I have to wait until he is released?

It will be more simple to wait for his release. But you can request an order for him to appear by telephone. The jail will follow the judgeicon's order.
