    Default accident settlement

    Husband living and working in LA. I had an auto accident a few months back. My Husband has asked for a divorce twice in the last 3 months ( once before the accident & once after the accident) He hasn't even come home to see the extent of my injures. He was in Fla. 2 hours from home and didn't stop to see me. But askes me whats going on with my doctors & lawyer. He is not helping me with any bills since the accident when I couldn't work. The insurane is in his name with me as wife & my car.
    My question is : Will he be Entitled to any of a settlement should I get one?

    Possibly. A personal injury settlement has some marital and non-marital components. The most obvious marital components: compensation for lost wages and prior-paid medical expenses. But most of the components of an injury settlement are not marital.

    Most personal injury cases end with a settlement. If the settlement details describe what portion of the settlement is for lost wages, then that portion may be subject to Equitable distributionicon. However, most settlements are not detailed. In such a case, the proceeds will most likely not be marital. To be certain, it will depend on what district you reside in.
