    Default Divorcing from a man who does not work!

    Married 8 years, two young children. Husband has felony on record making it difficult for him to get a job. I stayed home with children 4 years and returned to work. I work full time, college part time, and do everything in my power to stay financially stable. I initiated the divorce and was told by a lawyer that I could lose custody of my children since he takes them to school, picks them up, etc??? Is this true? Should I consult w another lawyer??

    Regarding the felony - whether this is relevant will depend on what the charge stemmed from, was there a conviction, and how long ago did this occur?

    The courts will do whatever it takes to serve the best interests of the children. If you work fulltime and then attend college part-time, the courts will want to know if you will be able to get the children ready for school, prepare their meals, help them with their homework, etc. If you are unable to perform these tasks (and your Husband can), then you may not receive majority of the overnights.

    Should you see another lawyer? It is always wise to get a second opinion - regardless if you like the first opinion or not.

    As for the felony, he was convicted of burglary in 1998 and has charges dealing with drugs during this period as well. He served time in prison (2 years I believe) and many other times in county jail. He has not been in trouble with the law since we have been together but that does not negate the fact that he cannot find employment.

    I have rearranged by work schedule so that I can take my children to school in the morning but have no choice but to have him pick them up in the afternoon!

    Thank you for your advice; I'm going to consult with another attorney tomorrow.
