    Default Witholding visitation

    Divorce decree states that if the ex fails to take parentingicon class I can withold visitation. It has been two months and his situation has not improved. He has moved twice in two months says that his tires were slashed on the car and he has been robbed(?). Since those incidents he has moved. He took visitation today after 3 weeks without due to his situation. A warrent was issued for his arrest due to FTA on a DWLSR. I know that I can withold visitation until he takes the class. We have a history of domestic violence. I am afraid of him for some reason and he knows how to get to me. I was telling him today that he will not get visitation until he handles his business. He convinced me to take the kids to him.

    How do I go about suspending his visitation until his situation improves. I am told that he is still controlling me. I am only trying to communicate with him about my concerns when he calls. Should I stop communicating with him all together and try to entice him to take me to court? (let a judgeicon handle it) My fear is that he will flip out again and do irrational things.

    Tough situation. It sounds like your safety is at stake. But there should be a concern for the children. He does not sound stable. Stories about tire slashing and robbery suggest he is completely unstable and has bad decision making capacity. Bad news for children that happen to be with him.

    You already have a court order backing you up. My two cents: withhold visitation until he finishes the class or takes you to court. I think a judgeicon would agree that there are problems here.

    Is phone contact considered visitation. Should I allow phone contact?

    Yes, phone contact would be nice. But it is not considered a substitute for in-person parentingicon time.
