    Default Ordered Child Support Cancellation

    My wife and I have been going through a divorce for a year now. I have been unemployed for most of it and ordered to pay $569 per month CS. I obviously can't afford to pay and the back support is mounting. Wife wants to know if she can call the CS Office and cancel support and file new once i get employed and also wants to know if she can cancel CS and agree on our own CS payment.

    You and your Wife can stipulate to modify ongoing child supporticon based on your reduction of income. Your Wife can't waive child support (ongoing), but can waive arrearages (past due support).     Brian. Thanks for the info. Can we not state that we wish to undertake a private arrangement? There are no state benefits being claimed by either party. Also, where can I find a CS Calculatoricon that allows for 50/50 sharing. We ant to go straight down the middle. Thanks.

    Private arrangements are dangerous. The only legitimate agreements are signed off by a judgeicon.
