    Default Spouse holds the purse!

    I may need to hire an attorney and file for divorce as mediation does not seem to be working out. Spouse holds the money as I now live out of town and the account with the funds needed are in her name although I have contributed equally to these funds. Can she withhold so that I cannot hire an attorney? Can my attorney demand she release these funds or sue her after the fact? Thank you.

    The funds can be demanded in a hearing for temporary relief. But depending on the court, hearings on temporary relief can be delayed for months.
