    Default have to fire attorney now what?

    Ok here is my question
    i am payed commission , my paychecks continue to go down as my divorce drags into month 7 without even a response from my exs attorney after 2 offers .
    I am out of money cant afford my attorney any more , the only time i hear from him is when he defends his monthly bills , , I gross 5600 month and am already paying 2600 to ex before any of my living expenses (including attorney ) as a alimonyicon/child supporticon payment , I was married 17 years 1 child ( 16 yrs old)
    I am about to fire my attorney , how do i get this before a judgeicon to finalize this proceeding? I feel i am paying a very fair amount will continue until my child is 18 , my final alimony offer will be 400 a month until she turns 65 or remarries as she is more than capable of working to support herself even tho she has had only off and on jobs in the previous years ( we are both 39 )

    You have the sole right to fire your attorney any time you want. Just send the attorney a letter stating such.

    Also, offer to sign a "Stipulation for Withdrawal" That may relieve the attorney of the need to appear at a hearing to withdraw. That will depend on the particular judgeicon.

    Gregg, With or without an attorney, there is a process before a final hearing is set. Have you attended a mediation yet? If you have, then you can set a notice for trial. If not, then you need to attend a mediation first.
