    Angry Ex filed for child support, NOT the father

    While married my son's wife had an affair, became pregnant and gave birth to another man's child. They are now divorced. They had a paternity test done but did not pay the extra money so it would hold up in court . According to the test and all parties concerned this is not his child but in order not to loose her medicaid she has filed for child supporticon from my son. A social worker told her that because there is no father on the birth certificate and the child was born during their marriage my son is the default father. She is currently living with the supposed " real father" . She says if they get money out of my son she will put it back in his account. Will he be held responsible for a child that isn't even his ? What can my son do to stop this and keep it off his record/reputation ? What should he do to keep them from getting one dime from him ?

    He could have taken care of this issue during his divorce. But my guess is that he decided to go without any help from attorney.

    There is no simple answer at this point. He needs to bring his divorce documents to an attorney for a consult and to discuss his options.

    The hardest part about this situation is many people do not realize if a woman is married at the time a child is conceived or born her husband is the legal father, regardless of if he is the biological father. At this point, he needs an attorney and he needs to hope that the mother is cooperative to make the situation a little easier.
