    Question Confused about QDRO'S

    Been married for 32 yrs. Husband has gambling problem last 2 yrs. We are both retired and I need to protect our annunities and Ira's. I'm not sure if I want to get a divorce yet - but need/have to protect my monies - or I'll be out in the street or in homeless shelter...how can I securely protect my half of all we have for the last 32 yrs.?? One attorney said you can use qualified domestic orders to split your annunities without divorce, another said you couldn't, unless you got a divorce....so which is it?

    A QDRO can only be sign by a judgeicon if there is an active case. The last attorney is correct.

    For any joint accounts, contact the institution which maintains the account. Request information regarding freezing the account. Regarding the QDRO, that is a document signed by the judgeicon in a divorce.
