    Default considering divorce

    I have been married 16 years. I work full-time and my spouse elects to work part-time. How does it work with alimonyicon. Hypothetically if I earn $5500 per month and she has the potential to earn $3000 per month. What am I responsible for? I calculated the child supporticon to be around $1250/month is that and her potential income considered? Also I want to be fair to the kids and let them stay in the house. But, I do want a life after divorce as well. How does it work if their is a house payment to make?

    "Potential Income" does not count for child supporticon purposes - unless that person is purposely avoiding work. As for alimonyicon - it depends on the type of alimony at issue. Potential Income is considered more frequently in alimony cases.

    There are too many issues in your post to answer them all. Regarding the home payment, if the home is not sold through the divorce process, then one party typically receives exclusive use and possession. The party receiving the home will usually be ordered to make the payment. However, the other party (as a form of support/alimonyicon) can be ordered to contribute to the home.
