    Default who gets the kids?

    My husband and I have been seperated for 5 months now. His mother made up a written agrrement stating he would have the kids every other week on a rotating custody, then 2 months later he decided to put them into daycare with out talking to me and stated I could only have them on weekends. I told him I disagreed wih it as I was a live in nanny and could be with the kids 24/7. So when they dropped the kids off that weekend I informed them I would be keeping them as there was no need for daycare . I told the soon to be ex husband that he could come se the kids anytime he wanted to and could call anytime, and he could have the kids every weekend as his mother (who he lives with is off on weekends and could watch them if nessary). However he never made any attempt to do so. Now this week he emailed me about having the kids for a week. I told him no since we had plans already and I asked him to let me know his days off and he could have the kids on the days he is off and on the weekends. However he is not wanting to that. I informed him the kids and I would be moving into my boyfriends house and he could still have the boys on weekends and his days off if he ever tells me he wants them then. However, now he is saying he is calling the cops because I refuse to give the address. I am in fear of my saftey that is why I will no do that. Is there a legal way for him to do that? I am not denying his right to see the kids he has chosen not to see them. I can I get in trouble of any kind for this?

    The police will not be interested in this situation. And arguments over parentingicon issues are not criminal acts.

    But you need to file a divorce asap to get some ground rules into place. The alternative is to have a tug of war over the children forever.
