My husband and I are separating and will be seeking a divorce. I am moving out of the house into an apartment. He says he spoke with an attorney and was told that the only time I would be entitled to half of anything in the house is when the paperwork is actually filed/signed. If I am leaving the house he says right now all I am entitled to take is my clothes and personal belongings such as pictures etc. Is this true? We have been married for 8 years and lived in this house together for 3 years.
Also, if I was to file is there a way to get him to pay for the divorce or at least part of it? I'm not in any financial position to have to pay attorney fees, court costs etc, especially since I have to now pay for an apartment on my own. He was out of work for 3 months and I supported us both, while he was having an affair with another woman. The house is in his name only as I was not working when it was purchased. Do I have any recourse whatsoever? I just cannot live in the same house with him any longer because of his adultrous behavior.

The courts typically order the spouse that earns a lot more money - to contribute toward or pay for attorney fees. But you will still have to come up with initial money for an attorney. Or you might be able to find an attorney that will attempt to get paid by the other side. Not many attorneys would accept the last option.
In my opinion, you can take a reasonable amount of items out of the house. The definition of reasonable is up for grabs. I suggest you take enough things to make yourself comfortable without emptying the house.
