    Default Arrearages and Settlement Agreements

    If a paternity and custody agreement was entered into, which modified the obligation of the father to make monthly child supporticon payments, but instead pay tuition and books for both children to attend private school. Does this terminate his obligation to pay arrearages that he owed prior to this settlement? (The settlement agreement does not make any specific reference to the arrearages).

    If there was no mention of arrearages, they do no go away. He still owes them - and you still have the right to enforce them.

    Thank you for your response. Is it possible to direct me to the proper form that I must file in order to obtain a judgment/order for the arrearages?

    You will need some version of a Motion for Contempt. Sorry but anything more is beyond the scope of this forum.
