    Default Joint Custody vs. Residental Custody

    My Husband and his ex-wife have joint custody of their two boys.
    The boys' elementary school inform my husband this morning that they had to be careful what information they gave to him about the boys attendance and grades because he was not the custodial parent and they could not release some information about teacher/parent conferences or IEP meetings.

    I was under the understanding that Joint Custody gave both parent full access to school and medical records. This should mean that if the boys' mother is called in for a teacher/parent conference or IEP that their father would also be notified and coordinated with, correct?

    Please advise whether my understanding is wrong.

    Your understanding is correct. You may want to see if the other parent is willing to sign a joint agreement - allowing full access to information. Otherwise you will need a clarifying order from the court.

    The boys' mother filed a pro se motion for sole custody in 2004 (six months after the divorce). However, she never had it served and my husband did not even learn of the motion until we took a look at the online docket.
    However, their acts on the belief that she has sole custody.

    Thank you for the information, we will probably be filing for a parentingicon plan with custody/visitation/child supporticon more clearly spelled out.
