Have a friend...need advise

Have a female friend that's been married approximately 13 years. In bad relationship...trying to find out options. She's stay at home mom with no independent income...takes care of their three kids under the age of 12. Husband makes the money ($150K/yr), but absent from raising the kids...always at work.

She has a prenup, so nothing if she walks. He threatens to take the kids/file for sole custody...make her life (more) hellish (even though he hasn't participated in raising kids. She's beside herself.

Wouldn't he have to pay child support? Wouldn't she get *some* money from the sale of their large home, even if the house is only in his name (not sure)?

That's the basics...they are in counseling, but she's not hopeful it will work out and unable to explore her options...he has her followed and videotaped surveillance, etc.

You cannot eliminate child support through a prenup - not possible.

If she has been the stay at home mom all these years ... she would have to be a triple-ax murderer for him to get sole custody (or majority parenting time).

Some prenups can be broken. She needs to get an attorney opinion.
