Parents Rights/Custody
ok here it goes. I was living in florida for 10 years with my family. Two years ago i had a son. The baby daddy was not with me during my pregnancy. He was present at the hospital when i had my son but my mom went with me because i had a c-section. He signed the birth certificate and that was it. He was insisting that the baby was not his because the baby skin complextion was white. Baby daddy is jamaican. When the baby was 6 mos he did a paternaty test and it was his. After that he lived in with me and my mom and brother. All this time he did not support the baby - he had no job. My mother was the one supporting all of us. I found employment and was working for a bit to support my family. He found a job for only 2 months but did not support the baby. We recently moved to NY because my grandmother was ill and my mom needed to take care of her. So we all moved in with my grandmother. All this time in NY he did not get a job to support his child. Things did not go well and us three, myself, babydaddy and our son. When we arrived in orlando he immediately stayed at his parents house still there and i was living with my son home to home with friends and my father. I was not feeling well so i went to the Dr. and he took his son to his parents house. My dad was upset with me regarding his home and was told not to come back. I again had to find a place to stay. I'm right now with my moms friend. I'm desperately wanting to go back to NY with my son my mom has a flight for me this sunday. I'm planning to go and pick up my son from his other grandparents house. Unfortunately, the baby daddy is not going to allow me to take my son to where i am. He does not know that i'm leaving to NY. He currently does not have any court proceeding on me regarding custody. After all that was done. It was told to me by our friend that he has told them that he wants his son and through me to the curb. Since our son was born he has not supported him at all. It was all me and my mother. He has threaten me with the US marshalls if i leave. Can i take my son with me back to NY. Please help me

It is not illegal for you to move with your son. The US Marshall will not have the slightest interest in this situation.
