    how do you get other spouse off the mortgage before divorce filing starts

    You do not have an ability to go through Divorce Court until and when you file for dissolution. However, it is unlikely that a judgeicon will change the names on the mortgage prior to the Final Judgment. You can speak to your Bank about a loan modificationicon or refinancing to see if they will allow you to alter the names on the mortgage. Very difficult process in this economy.
