    Default 401k in divorce

    Am presently going thru a no fault divorce. I had a 401k started before the marriage I know the contributions before the marriage are non marital but are the earnings during the marriage on the contributions before the marriage marital or non marital assets

    If all of the contributions were from before the marriage, the entire account is non-marital. But if this is really an uncontested, the division is whatever the two of you agree it is.
