    Default Help

boyfriend has been trying to get a divorce for over a year, he lost his business along with the income, has been attempting to represent himself in court with no luck. Since he can't afford a lawyer. They have been basing his child supporticon on income he used to make when the business was good. Business no longer in existence..Since then he has filed for motions to ammend child support based on his current income they have denied everything he has done. Yesterday Hillsborough County Sherrifs Office came to pick him up at my house for $5K he is behind on child support. He is working part time and they are taking out a small percentage from his weekly paycheck. (in which has been provided to the courts)

my questions are : what are his rights? why is the judgeicon only basing it on what the ex attorney is throwing out there with no proof? How long can be detained for?

Is there a way a lawyer can take his case (Pasco County) that can represent him and possibly make installments for his services.

Also, I have been paying for his car insurance and somehow the attorney obtained my debit information? is this legal?
They have also subpeona my bank records for the last year, can they do this? He is not even on my account?

    In desperate need of help..

    He should try legal aid.

An order of incarceration must have a set amount of money that must be paid for an immediate release. That amount should be on the last court order.

An attorney is allowed to look into any records that have any remote connection to the case - including the records of a housemate.

You need to call around. Different attorneys accept different types of payment plans.

    Default Another question?>>

Ok so since he is in jail, and they said that the only way he can leave is to pay the full purge amount or wait for his hearing with the judgeicon..
can i contact the judge to try to get a hearing set? or will we just have to wait?

He is automatically released once he pays. You can file a Motion to Re-determine the purge if it is too high. You will then need to schedule a hearing with the judgeicon's office.

Can i do the motion on behalf of him? Or do you have to be a lawyer to do such? And if I can, where can i get documentation from?

You can find some forms on flcourts.org.

You cannot do it on his behalf unless you are an attorney.
