    Default child support and visitation

    Did I make a mistake? Ex husband has paid a total of 3 partial payments in two years. I am going to the department of revenue to seek enforcement. I have been told not to expect a lot of the arrearage that has been acumulating that it will be settled in court because he has stated that although his business earned a lot of money he didn't get any income his business partner did (girlfriend). He is now working for another company doing contract work. He has a huge amount of debt that was accumulated after the divorce and has no money. Was waiting until he went to work for someone else a mistake?

    As this matter will end up back in court he does not follow the visitiation that was set up in our divorce aggreement. (which is ok with me) I drive my daughter several 100 miles every three weeks to spend a day with her father (no overnight) 100% my expense. Will this help or hurt my case?

    The arrears will not go away. The court will not wipe them out - no matter what his story is. The problem is that you are dealing with a deceptive and complex situation. The DOR will not do a bunch of work on this - they limit their work to the quick and simple. Whatever they do for you will be a roll of the dice. But it IS free

    The fact you do all of the driving certainly will not hurt your case. Whether it will help depends on what you are trying to do.
