Should I get a divorce or annulment

Hi:

I am planning to file a divorce, but I am not sure how to proceed. Here is my dilemma...

I first got married in 2005. After 2 years, I found out my husband was not divorced from his wife. Within that year (2007), he filed for a simplified divorce from his wife. After his divorce was finalized, we had a notary perform our ceremony; however, we never filed a formal annulment for our marriage.

At this point in time, I am seeking a divorce but I am not sure if it should be a formal divorce or whether our marriage is void which I would then proceed with an annulment. I await your reply.

I believe you qualify for either one. A divorce is always more simple.
