    Default Can the father dump child off or can I get him?

    My husband walked out on us two weeks ago. His mother was a huge part of the problem. Last weekend I let him have our child friday-sunday. This weekend I did the same. My husband works monday thru friday until 8pm or so at night. I have arrainged my schedule at work so that I can be home with my child mon - friday until he picks him up so that I don't have to have his mother watch the child anymore and because my child needs me right now. Next weekend I have to go on a trip in state for a week for work and my child was approved by my work to come with me. He is thrilled. His father brought him home tonight (sunday) and wants to pick him up again wednesday and keep him till friday, problem is, he works, I don't want the child to be dumped off at his grandmothers all day, and he wants to be home with me. My husband says too bad and when he picks him up wed. he is not bringing him home till friday. He said there will be trouble if I dont' have him ready wednesday night. Do I have to allow this? Should he have to stay with his grandparents all day if I'm home and he would rather be home with me? Is there anything I can do?

    I need more information, is there a divorce order, have you filed for divorce? However, without a divorce order, if you husband leaves him with a grandparent, you can immediately go over and get the child. A third party does not have more rights than a parent. You can take the child with you on your trip and you do not have to give your husband your child on Wednesday. However, if you have an order that says differently, then you need to abide by the order?

    Allison, There has been no order yet. I just had my consultation and am paying my attorney today.

    A third party does not have more rights to your child than you. If your husband leaves your child with his parents you can go get your child.
