magistrate instead of judge

my husband had court on may 19,2010 there was a petition he file to modify child custody and to modify child support since feb 9, 2010.the judge transfer his case to where he lives so the judge did not talk about his petition now on the court he send a letter to the new judge requesting a hearing for the petition and the send him a hearing with the magistrate to talk about visitations...why are they dooing that? my husband send another letter letting the judge know about the petition and they send him another letter saying he has to go in front of the magistrate first. how can he get the judge know he wants to go in front of him and not the magistrate..

A lot of judges will refer the case to a magistrate when there are no attorneys involved. I believe this is a positive thing because magistrates are more used to working with self-represented people.
