    Unhappy granmother in control

    my children were taken from me and my ex in 2001. their grandmother was appointed temporaray custodian and given the children. my ex and I got out of jail in 2002, since then we have been raising the children we have them 90% of the time. we raise our kids while she continues to collect all the benefits including child supporticon from me. on may 20 she dropped the kids off and said they were mine that she could not handle them anymore. she said she was going to drop support and turn over custody to me. 2 months went by and she did nothing so I filed a motion to suspend child support and filed for medicaid for the kids. immediately after she found out she was losing benefits she threatened me with kidnapping and took kids back. having no regard of the fact they had been with me for 3 months were enrolled, started school or anything. me and my ex are working together to get custody of the children. what can we do to get the ball rolling asap? what are the correct petitions to file and can she be charged with fraud ?

    From what you said - my guess is the order came from a type of court called "Dependency Court." You must file a petition in that court. There is a lot of info missing here. Did you receive a case plan? If so, did you complete the plan?

    there was an unfinished case plan. I did not finish but my ex did. the case was closed before I was able to finish due to incarceration.

    Then things may be a bit more complex. There is some chance your parental rights were terminated. You probably need an attorney to review the court file.
