    Default Relocation with minor child

    Hello, I am trying to go through the process of filing paperwork to relocate my child from Florida to NY. I was offered a job in NY a few months back, I hired an attorney to file the paperwork but it is taking longer then expected. I just relocated my child here a week ago. I left her in Florida as I thought this would have at least been filed in the courts already. It hasnt. Dad has not been paying support and rarely sees the child. Now that he knows that this is going to take place he wants to see the child. I had to come here because I have been out of work for almost a year and with no support from him I had no choice. Can they make me go back now? I dont know what else to do. I searched 11 months in Florida until I finally made the decision to branch out elsewhere. I was at risk of losing everything if I didnt take the job.

    Default Relocation

    For a relocation case the parent desiring to relocate more than 50 miles from the current residence must comply with Section 61.13001 of the Florida Statutes. The parent must either (a) obtain a written agreement in accordance with 61.13001(2) of the Florida Statutes from the other parent or (b) serve a signed/notarized Petition to Relocate giving the other parent 30 days to object to the relocation and to request a determination by the Court. If the parent fails to comply with this Section then they may be subject to Contempt and other proceedings to compel the return of the child, and such non-compliance may be taken into account by the court in subsequent determination or modificationicon of the parentingicon plan...etc.

    Ok thank you.

    I am trying my best to do everything legally and correct however, I am not going to be homeless in the process. I will continue with my current processes.
