You mentioned "Common Law Marriage" in the title to your post. Have you gone through a legally sanctioned wedding ceremony? Because if you have not - there is no common law marriage in the State of Florida.

If I want to "divorce" and the house is in his name, then how would I be able to get the house if by my self I would not be able to buy the house outright? We have 2 kids and I would like to disrupt their lives as little as possible. Wouldn't the current mortgage have to be paid off? I may not be able to get a loan to purchase the house in my name.

There was no legally sanctioned ceremony, so I probably wouldn't have any right to the house then?
Most likely - that is the case. Florida abolished common law marriage a long time ago.
