    Default My rights?

    My ex of 10 years and 5 kids has moved on and almost everyday is a argument. We still live in the same house at the moment. I am currently disable and in 2nd stage of SSI. I am from California and we moved here together cause she said she had a job already and all current help/assistance would be in place when we got here. None of which was true. She is constantly picking fights trying to make me hit her cause she says and I quote hit me, hit me, you gonna hit me? I ask her why she wants me too. I tell her I wont do that. Are you crazy? She is constantly threatening to take the kids and shut off the all utilities. I have section 8, and she says If I don't give it to her. She or her dad wont pay the bills after this month. I should get my answer this month according to SSI. If I'll get it. Which would be enough for me to stay and be around our children. Currently we are getting family assistance because I went and did it for our family. She said she tried two times and it was done but never happened. Since October 2009. I went and did it myself and got it in August 2010 (this month) Now she wants to take the cash aid and move out since under rules/law the mother is put as the case holder/payee. What are my rights as the kids father. Could I move back to California where I have everything set up for the children? We were never married Someone please help

    If you were never married then you have a paternity action and a claim for child supporticon/time sharing. You would need to come in for a consultation as there seems to be numerous issues at stake and too deep for an answer through the forum.
