    Unhappy Trying to get divorced before I move.

    My husband left the state after I moved out. He refused to come back to go to court and I could not get a hold of him after that initial conversation. I filed for divorce and whatever I had to post was posted for the four weeks. I filed the default paperwork (as I was instructed by the clerk's office). It has been a month since I filed the default and I still have not received a hearing date. I am moving out of state at the end of the end of this month. Is there anything I can do to get the hearing so that I do not have to come back just to attend the hearing? Is there anyway I can not attend the hearing even though I am the petitioned due to the circumstances?

    You could file a notice of trial. This may trigger the court to look at your case and set it. However, it may not get you into court fast enough. It probably may be wise to hire an attorney to see if they can get a hearing date for you and have them attend with you. If the date is set after you move, you will have to attend that final, if you fail to attend, the case will be dismissed.
