Unless there has been a determination of paternity, the mother has the rights to the child. Furthermore, sometimes even when there is a 50/50 agreement, one party still may have to pay child support.

What information and forms other than the Financial Affidavit (short form) is needed for Financial disclosure?
Also, I was willing to agree to a 50/50 joint custody but my son's father has repeatedly threatened to take my son away if I continue to ask for child support. I have been a stay at home mother for the last year and a half and am trying to find work. The only reason I am asking for child support is in order to be eligible for daycare assistance. As there is no current order in place our son has been staying majority of time with his father as I cannot afford daycare while I search for jobs.
Recently his father has displayed behavior that worries me in regards to the care of our son. A paternity case has been filed, but not closed.
Since the case has not been closed who has legal custody of our son at this time? And what steps can I take to make sure he is safe while at his dad's?

Mandatory Disclosure is the minimum set of disclosure. It consists of the financial affidavit, paycheck stubs or other evidence of income, bank statement, and a tax return.
But you have the ability to request any and all documents you want from the other party.
