    Default Age of child support termination

    My daughter turns 19 on October 12 but she is still a senior in high school w/ a graduation date of May 2011, her father wants to terminate child supporticon on her birthday. Can I file to have him pay until graduation even if our divorce papers state that it should terminate on her birthday? If I can file what are my chances of success? Also can I file to receive support through her college career? --Loretta

    child supporticon is owed until the child is 18 or graduates from high school if the child is reasonably expected to graduate by their 19th birthday or the 19th birthday. I do not think you would win if your fought to get child support paid until she graduates. Also, there is no duty to pay child support through college.
