    Default Seperation and child support

    I was separated from my wife since my son was almost 1 he is now four. I have been sending her money through my bank account to hers for his support but was told that in the future those may just be seen as gifts since there is no order of support. Since florida does not recognize legal separation how do go about getting something which is official which the court would recognize. I want to do things correctly until either of us can afford to file for a divorce

    Those payments are support - no two ways about it. And if you ever go through a divorce, the court will see the payments as support.

    The only possible catch: you must keep proof that you actually made the payments. Images of cancelled checks will do.
