    Default Custody evaluation

    Can email of a minor child (14 years old) be brought in court for custody evaluation? During the parents separation, the child alternately stays with each parent for a week. The child has sent an email to a parent expressing his/her feeling as who he/she would like to stay longer with, as well as his/her happiness and sadness when he/she was moved to the other parent's.

    Maybe, maybe not. That email would be labeled as hearsay - which is excluded from court. Every now and then a judgeicon will want to see it regardless of the rules.
