    Post 50% 50% percent custody

I've been separated for 2 years and we haven't filed for divorce because we have a disagreement. My husband wants 50% 50% our 5 years old daughter custody. She lives with me and I'm the one supporting her (he pays her health insurance, after care programand and prepaid college). He sees her on his days off twice a week for 2/3 hour, sometimes only once a week and he had even spent 2 months without seen her. He keeps saying he is gonna move to up North but he wants to get the paper done before that. Can he get 50% of the custody even is he is planning to moves to another state??

I do not see how that is even possible.

Question 50%-50% vs State of Residence

If you have a good reason (like a better Job Target or Company Investment), and you are under a 50%-50% joint parentingicon, how can you deal with moving out and the other parent? or you can't move out while you are under 50%-50%?
    Any exclusion on/to the law?

You can move if you can convince a judgeicon the chance is in the interest of the children. There are other factors - but that is the basic one.
