    Default Served papers

    My wife and i have been talking. I knew papers were going to be served and they just "arrived". She said we have 20 days and this isn't final. We have talked about trying to save our marriage and attend counselling. My question is what steps to take in the meantime? The way I understand is after 20 days I am screwed if I don't take action. If it looks as if we can still make this work, do I still spend the money to be represented by a lawyer? Any other steps I/we should take? Thank you for any advice or info...

    If she simply "handed" you the papers and you did NOT sign an acceptance of service then the 20 days should not have started. If you were personally "served" by a sheriff or process server then the 20 days begins on the day you were served. Even when/if you both believe you can come to an agreement you should ALWAYS file an Answer within the 20 days and provide a copy to her or her attorney if she is represented.
