Default thinking about suing for full custody

my boyfriend and i were never married, and split up when my daughter was one. She is almost four now, and we do not have any legal custody agreement. My current boyfriend and i are getting married and just bought a house, and are having major complications with her father. He lives at home with his parents still and has been through like 6 jobs in 2 year. he has two arrests against him in the last six months, and his family has mental issues. But i work three jobs and go to school full time. what are the chances i will loose the case because of my work hours, even with his history... would it be worth the time and money on my part?

You can Petition for Time Sharing and child supporticon and argue for majority time sharing and residential parent for school designation purposes. The thing is that it is very unlikely that you or he can get "sole" parental responsibility. That is given so rarely and your facts do not warrant it. It might be wise to ask for shared parentingicon with ultimate decision making authority. Now, if he is a convicted felon that is a different story. Feel free to call or come by for a free 1/2 hour consultation to learn more about time sharing.

    Question

    1. What should be the "time sharing" recommended (and your feedback) on court as Today?
    I mean like for example:
Mother: 1 week & Father: 1 week --- or --- Mother: 2 weeks & Father: 2 weeks, or other combination...

    2. Once the petition is filed, who will be involve in the determination of the petition?

    3. Can I make changes to the petition during the process or I must file a new petition, new case, new everything? (like if I filed/requested "SOLE", can I change to "75%"? or "75%-25%" changed to "50%-50%"?)

    4. How the majority could be specified towards the request of the time sharing?
I mean the majority terms (and all the argues) will end on math (number of days/overnights) with the child, how and what should be a reasonable majority request?

A few questions but the quick answers will clear the way this new time-sharing is seen and interpreted on court as today.

    thanks in advanced
