    Default New Child Support law

    Hi. I was divorced several years ago and have just under 40% of overnights with my children; therefore, I pay the maximum child supporticon amount for my income. I assume that it is not possible to modify my child support payments according to the new law?? However, if there are any modifications to our timesharing schedule (my children want to spend more time at my house), is child support recalculated under the new child support guidelines (with the 20% treshold) or under the guidelines that were in place at the time of my divorce (40% treshold)? Thank you for your time.

    Any modificationicon brings your case under whatever new rules are in effect at the time of the modification.

    You do not need to modify time sharing just to get support recalculated. Any time child supporticon would change by $50 or 15%, you are allowed to file a modification case. In your situation, it sounds like there would be significant savings.
