    Default How much Power does a General Magistrate Have in enforcing a Contempt

    How much authority, power does a Magistrate have in enforcing a Contempt.? I read somewhere they can do that immediately...? Is this true.

    Went before GM on Nov 1, held her in contempt and warned her that if she continues to not let me have my timesharing rights, he would give my son to me.
    She rejected his recommendation.
    I filed another contempt and motion to pick up child (denied by judgeicon) and also a modificationicon to change visitation as well.
    Judge referred the new contempt over to GM again.
    1. Will the Judge hear the new contempt and motion of visitation change since she rejected and now we wait for a hearing by the judge. or is it best to go before the GM again for the second Contempt and new motion of change of visitation.

    How much power does the GM have to enforce Contempt?

    I suspect you have not choice and must go before the GM.

    A GM can issue a Report and Recommendation to hold someone in contempt. A circuit judgeicon must sign off on the report. Except in rare circumstances, the circuit judge will always sign off on the report. So the answer is: yes, a contempt order by a GM is a real order.

    Default Objection to General Magistrate

    Went to GM on Nov. 1, GM held my ex wife in contempt for not allowing visitation

    She filed an objection to the GM recommendation that included holding her in contempt and also warning her that if she did it again. Still not allowing me to see son even after all of that. She filed the objection.
    Can I file and objection to see the GM
    In otherwords I would like to go back to the GM to have it known that she violated again, after being told she was in contempt...
    She doesnt care what the courts say...she said no court or judgeicon is going to tell her what to do with her son.
    It will obviously takes months to get to see the Judge anyhow?
    Its faster to see GM it took three months the last time....
    I have not seen my son in two years. Its been held up in the courts. I pray they will give me my son finally after seeing what she is doing.

    I think you have enough going on where you could benefit from an attorney opinion. You are asking what the correct strategy is for a bunch of events that need further description.
