I have lived in Sarasota, Florida since Feb. 2000 and was granted a divorce in Florida 2009 my ex moved to Texas June 2009 with our 2minor children. Now the children a girl 16yrs., boy 10yrs. have been living with me as of July 2010. He has granted and signed and notorized a letter granting me primary custody of the children.

Plan by ourselves to save money. Does a mediation or going to court have to be settled in the state of Florida? He wants mediation and if we have to go to court to be done in Texas.
I stated that all holidays during the school year will be with the mother(me) and he gets winter, spring, summer to be spent with the father. He wants me to change the school holidays to reflect both of us in case he ever comes to visit. He said if its not written I can deny him..I wouldnt but also he is estranged with the children so it would be up to them too.

Hey, my husband and his ex put a clause in their agreement that since he lives out the state, of he knows of a time that he is coming in-state, he will give 10 days notice to be able to see that kids. Also, even though he wants you to got to court in Texas if need be, the hearing will have to be within the state in which the children live because that state reserves jurisdiction. Hope this helps.
