    Default Can I file contempt?

    My ex and I are in the middle of getting a divorce, we have minor children. I have our 9yr he has our 12 yr old. That is how the kids want it also.
    There are no custody agreements yet.
    There is a Temporary standing order filed with the courts.
    He is leaving on vacation for 2 weeks with my 12 yr old but I told him that I did not want him to take my 12 yr old out of the state. I even hand delivered a letter to his attorney stating this 2 weeks prior to his planned leave date.

    If he leaves and takes my 12 yr old with him, is there anything I can do? Is this contempt?

    If there is no court order on time sharing then this would not be a "contempt" situation. You can and should file a Notice of Objection as to his proposed vacation with the minor child and ask for an expedited hearing on the matter.
