    Question Payments of Child Support and or Alimony

    Lived in this state for 6 plus years. Moved here because I am on total disability. Had wife and 3 daughters. 20 marriage wife said we are done. I heard that this state can not touch disability income. My girls already receive SS income of 939.00 monthly. I have disability from Veterans and also United States Post Office. Is this true? Would a court be allowed to Garnish Disability income or be able to force me to pay? Wife has a good income and has a roomate paying half.

    An award of alimonyicon is based on the needs of one spouse and the ability of the other spouse to pay. Assuming the roommate is contributing to her household bills, her need for alimony would decrease. If she is making more than you, then she has no need for alimony. Florida law does consider disability payments as income and so the monthly amounts you receive will be factored in to any calculation of child supporticon or alimony. After the child support amount is calculated, it will be reduced by the monthly SSDI amount that your children receive. If the benefits amount is less than the calculated support obligation, you will be responsible for the difference.
