Rights if I move out?
My mother in law has been living with us for almost 1 year and has caused many problems in my marriage. I have told my husband on numerous occassions she needs to leave, but he refuses. It has come to the point, if she won't leave then I have to - the only thing that has stopped me so far is that we have a 13 month old daughter -- I am not sure what my rights are if I move out and we are not legally divorced. I would want her to come with me, but could my husband stop me? (note I still breast feed for some meals so my daughter still needs me). Any advice you can give would be greatly appreciated.

If you move out of the residence and take the child with you it would be wise to let the father know where you have moved to, stay in close proximity so the exchanges will be feasible, set up a time sharing arrangement with father for when he can spend one on one time with the child, and attempt to resolve child support

If you refuse to cooperate with him on time sharing then the court might look less favorably on you. Keep a journal and all correspondence between the two of you as it may be used in a future "custody" proceeding. You should not relocate out of the county without his approval (written) or a court order because he can get the family law court involved.
