    I have been separated from my husband almost a year and we have been married for almost 9 years. He decided a year ago that he wanted out and I was forced to find an apartment with my 16 year old son ( not his child). I have been struggling and lost my job last year.

    I would like to know if and when I file for divorce what I can ask for. I read on here that 401 is only given to a spouse who has been married for more than ten years. Is he liable to pay child supporticon although my son is not his child. Can I also ask for him to pay alimonyicon.

    I am so lost in this whole matter and can't afford an divorce lawyer at this time.


    Please advise.

    When you file for a divorce you can "ask/petition" the court for alimonyicon. Whether or not the court will grant alimony is another matter. Time sharing and child supporticon will not be ordered for a child "not in common" with the parties. You can request the court divide the assets and liabilities incurred during the marriage and to divide the retirement accounts.
