    Default Attorney Fees and Withdrawing Motions

    1) I filed a motion for child supporticon and custody but have not served it yet pending retaining an attorney. I thought I had one, but money is an issue. Can I withdraw that motion and file a new motion requesting my attorney fees be paid by estranged husband? I don't work, stay at home mom.

    2) Estranged husband has an attorney and filed temporary orders to take place on my motion date, can I then ask for a continuance to secure counsel to level the playing field? What happens to their temporary order requests?

    You can withdraw a motion or file an Amended Motion but any documents you file with the clerk of court MUST be sent to opposing party/attorney.

    You can ask for a continuance of the motion hearing date in order to obtain counsel. File a Motion to Continue.
