    Default Relocation wth minor child

    If Mom and Dad were never married but Dad is on the birth certificate - can Mom (who has since married another person) take child out of state if current spouse is in the military or does there have to be a hearing to approve relocation?

    There is no court order for visitation and/or child supporticon yet, but there is a case awaiting hearing on these issues.

    The Dad is very concerned that Mom can just up and move with child out of the state of Florida and he has no way to keep this from happening.

    If there is a pending paternity or time sharing action then neither party can relocate out of the court's jurisdiction without permission of the court or other party. You need to consult a lawyer and provide more detail.
