Have a question re: Florida Prepaid College Fund

My soon to be ex started a Florida Prepaid fund a couple of yrs ago for our now 11 yr old son. The money was deducted monthly from our joint checking account until we seperated. From there my ex had it deducted from his pay check.

My ex has since lost his job. Two weeks ago, he contacted Florida Prepaid to have the money refunded back to him. I received a copy from them notifying me of this info. I found out apparently we are not on it jointly but only my name is listed as Survivor on the account. Can he legally receive all that money? Wouldn't I be entitle to receive half of the amount that was taken out of our joint account when we were together?
