I pay child support
and the mother of my children will not allow me to see my children. Recently I found out, from my younger daughters, that my 14 year old daughter, their older sister, was pregnant. I called child services to investigate and ultimately found out that my daughter was raped and impregnated by the 36 year old brother of her husband, who is now in jail for the crime awaiting trial. My question is how can I get visitation rights, or even custody for my children. And would I have to pay the courts? I feel that my children are still in danger. I have called the social worker that is on the case several times, and she has not been very responsive. As a matter of fact all of the knowledge that I have gained is from my younger daughters, who sneaks a phone during school hours to brief me as to what is going on, as they have been warned to not contact me in any way form or fashion by their mother and her husband.

Protect yourself
You need to file an emergency custody/visitation motion and or an emergency motion for a temporary change of custody. You will have to pay filing fees and document preparation. Unless the courts feel you are a danger to your kids you have a legal right to visitation! GET AN ATTORNEY NOW!!

If you previously filed a paternity case, you can reopen the case and file an emergency motion.
Or ... continue to pester the case worker until you see some forward movement. You can also file future reports with the abuse hotline - 800-96-abuse

I appreciate the response. Do you happen to know if legal aid lawyers handle these types of cases? I want to get my kids to safety,and right now, sadly, I can't afford an attorney.

It is worth a try. But they are very selective. And I do not envision them accepting this kind of case. But again, you should apply.
