Who decides?

I currently share custody of my 5 year old son with my ex-gf. We were never married. She cheated and left me when my son was 11 months old. We've shared custody 50/50 ever since. We now live in different states. (I live in Miami Beach with my live in gf of 3 1/2 years) My son's mother lives in Baltimore. My son will be starting kindergarden in the fall and it's yet to be decided where he'll go to school. I know she is expecting him to go to school up there with her, but she has a hard time disciplining him and I know that we can offer him a better life here. My question is, if we can't agree on which parent will have him during the school year, who decides? What factors are taken into consideration? Any advice would be very much appreciated.
